Enforcing a Divorce Judgment in Israel
When the Other Side Does Not Comply

Enforcing Alimony Orders — the Execution Office
When an ex-spouse stops paying alimony ordered by a court, the primary enforcement mechanism is the Israeli Execution Office (Hotzaa LaPoal). Opening an enforcement file is a straightforward process: you file an application with the judgment or approved agreement, and the Office issues a formal demand to the debtor.
If the debtor ignores the demand, the Execution Office can take escalating steps:
- Wage garnishment — up to one third of the debtor's salary is transferred directly to you
- Bank account seizure — funds held in the debtor's accounts are frozen and transferred
- Property lien — a charge is registered against the debtor's real estate or vehicles
- Travel ban — the debtor's passport is confiscated and they cannot leave Israel
- Driving licence suspension — the debtor loses the right to drive
- Imprisonment for contempt — as a last resort, persistent non-payment can result in imprisonment
Where enforcement proceedings are proving difficult — for example because the debtor has hidden assets or is self-employed — an application can be made for state alimony from the National Insurance Institute as an alternative source of payment while enforcement continues.
Enforcing Custody and Property Orders
When a parent does not return a child after visitation in violation of a custody order, this is a serious matter. The remedy is an urgent application to the Family Court. The court can order the immediate return of the child, impose fines on the non-complying parent, and — in repeated or serious cases — reconsider the entire custody arrangement. Document every violation: dates, times, messages, and any witnesses.
Property transfer orders — for example, an order to transfer the family apartment or divide a joint bank account — are enforceable through the Execution Office. Where the debtor refuses to sign a transfer deed, the registrar may sign in their place. Daily fines for non-compliance escalate quickly and are designed to remove any financial incentive to delay.
Contempt of court proceedings are available for any breach of a court order — not only financial ones. A party who persistently ignores custody arrangements, refuses to vacate the family home, or withholds property may be found in contempt and face fines or imprisonment. Israeli courts treat wilful non-compliance with their orders as a serious matter.
