What is Joinder of Claims (כריכה)?
Under Israeli law, rabbinical courts have exclusive jurisdiction to grant a Jewish divorce (get). But their authority extends further: when a spouse files for divorce in rabbinical court, they may simultaneously join — כרוך — all related matters to that court. This means property division, custody, and alimony can all be decided by the rabbinical court rather than the civil family court.
The practical effect is significant. By filing first in rabbinical court with a full joinder, one spouse can prevent the other from choosing to litigate property or custody in family court — at least until the jurisdictional question is resolved, which can take many months.
Timing is everything. In many cases, the spouse who files first determines the entire litigation map. A delay of even a few days — while your spouse consults their attorney and files — can fundamentally change where your divorce is decided and what rules apply.
Strategic Considerations — Rabbinical Court vs. Family Court
Advantages of rabbinical court for property: Rabbinical court tends to apply more conservative approaches to marital property. It is generally more flexible, less influenced by religious doctrine, and better suited to complex financial disputes involving businesses or international assets. Family court judges have specialised training in child welfare matters.
Protecting yourself if your spouse joins all claims: If your spouse has already filed in rabbinical court with a joinder, you still have options. You can challenge the joinder on procedural grounds, file competing motions in family court, or negotiate a consent agreement about which court will hear which matter. None of these are simple, and all require experienced legal representation from the moment you learn your spouse has filed.
