What a Separation Agreement Covers
When spouses decide to live apart, practical decisions cannot wait for the divorce to be finalised — which can take months or years. A separation agreement sets out binding interim arrangements so both parties know exactly where they stand.
Interim financial arrangements address immediate money questions: who continues to pay the mortgage or rent, how household expenses are split, and whether one spouse pays interim spousal support to the other while proceedings are ongoing.
Housing arrangements determine who continues to live in the family home, whether the other spouse must find alternative accommodation, and whether the home may be sold or mortgaged during the separation.
Temporary child custody and support define where the children primarily reside, the parenting schedule for the other parent, and the amount of child support paid — all subject to the Family Court's overriding jurisdiction to act in the children's best interests.
Protection of assets during the separation period — a key function. The agreement can prohibit either spouse from disposing of, mortgaging, or transferring jointly held assets without the other's consent, preserving the asset pool for the eventual divorce settlement.
Is a Separation Agreement Binding Under Israeli Law?
A separation agreement is a valid contract under Israeli law the moment both spouses sign it. Each side is legally obligated to honour its terms. However, without ratification by the Family Court or Rabbinical Court, enforcement requires filing a separate civil lawsuit — which is slower and more costly than enforcing a court order.
Advantages of interim court orders instead: In some situations — particularly where speed or certainty is critical — it is better to apply directly for interim orders from the Family Court rather than relying on a private agreement. Interim orders are immediately enforceable and can be obtained on short notice. They are especially appropriate when there is a risk of asset dissipation or when one spouse refuses to cooperate.

From separation agreement to final divorce settlement: A well-drafted separation agreement often forms the basis of the final divorce settlement (הסכם גירושין).
