When Israeli Courts Grant Shared Custody

Israeli family law has undergone a meaningful shift in the past decade. Whereas courts once defaulted to awarding primary custody to the mother — particularly for young children — recent case law between 2022 and 2023 reflects a more balanced approach. The Supreme Court and district courts have repeatedly affirmed that shared custody can be in a child's best interests when the circumstances support it.

Courts assess several factors: the age of the child, the degree of parental cooperation, the proximity of the parents' homes, each parent's availability and work schedule, and the child's own wishes (weighted by age and maturity). A cooperative co-parenting relationship — or at least the capacity for one — is among the most important conditions for a shared custody order.

It is important to understand that "shared custody" does not automatically mean a strict 50/50 split of nights. The term refers first to shared legal authority — both parents make major decisions together regarding education, health, and religion. The physical schedule can take many forms: alternating weeks, a 5-2-2-5 pattern, or other arrangements tailored to the family's reality.

Research cited by Israeli courts consistently shows that children benefit from meaningful involvement of both parents — provided the inter-parental conflict is managed and the transition between homes is smooth. Shared Custody and Child Support

One of the most common misconceptions is that shared custody eliminates child support. In Israel, this is not the law. The National Insurance Institute (NII) sets a minimum child support payment that is calculated primarily on the basis of income differences between the parents — not on the time-split between homes.

Even where parents spend equal time with the child, if one parent earns significantly more than the other, a court may still order the higher-earning parent to pay child support. The rationale is that children are entitled to benefit from both parents' economic capacity, regardless of the custody arrangement.

That said, shared custody does tend to reduce child support payments compared to a primary custody arrangement, because each parent directly bears the costs of the child during their own time. A detailed parenting agreement — specifying how ongoing expenses, education costs, medical expenses, and extracurricular activities are divided — is essential to avoid disputes.
