What Is Temporary Alimony — Interim Financial Support During Divorce
Temporary alimony (מזונות זמניים) is a court order requiring one spouse to pay financial support to the other — and to the children — during the period of divorce proceedings. It is not the final financial arrangement; it is designed to bridge the gap between separation and the completion of the divorce.
Israeli family law recognises that divorce proceedings can take a long time, and that the financially weaker spouse cannot simply wait without income. A motion for temporary alimony can be filed in family court or, where applicable, in the rabbinical court — and in urgent cases a court can grant an order within weeks of filing.
The order covers two main categories: spousal needs — such as housing, food, and basic living expenses — and children's needs, including education, healthcare, and daily costs. The court reviews each component separately and tailors the order to the specific circumstances of the family.
When assessing the amount, the court considers the income disparity between the spouses, the standard of living maintained during the marriage, the immediate and demonstrated financial needs of the applicant, and the paying spouse's actual capacity to pay. The aim is a workable interim arrangement — not a punitive one.
How to Apply for Temporary Alimony in Israel
A motion for temporary alimony is filed in the family court (or rabbinical court, depending on which forum is handling the divorce). The motion is accompanied by supporting documentation that demonstrates need: proof of income — or lack thereof — pay slips, bank statements, and a detailed breakdown of monthly expenses for the household and children.
When the financial situation is urgent — for example, the other spouse has stopped contributing to household expenses or has left without making arrangements — an emergency motion can be submitted. The court may issue a temporary order without waiting for both sides to appear, and schedule a contradictory hearing shortly afterwards to allow the other spouse to respond.
The timeline from filing to an initial order is typically several weeks in an ordinary motion and potentially days in an emergency. Once issued, the order is binding and enforceable — non-compliance can lead to enforcement proceedings through the Execution Office (הוצאה לפועל).
Temporary alimony remains in place until the divorce is finalised. In the final divorce judgment, the court reviews all financial matters — including how much was paid on an interim basis — and sets the permanent arrangements.
