Advance Notice of Termination in Israel

Notice Period Entitlements
The Advance Notice for Dismissal and Resignation Law (2001) requires both employers and employees to give advance notice before terminating employment. The length of the notice period increases with tenure: from one day per month of service in the first six months, up to one full month's notice after the first year.
An employer who dismisses an employee without notice — or pays less than the required notice — owes the equivalent salary for the shortfall. This amount can be claimed in the Labor Tribunal within seven years. During the notice period, the employment relationship fully continues: pension contributions, sick days, and accrual of rights all apply.
Pay in Lieu of Notice
Where an employer does not wish the employee to work the notice period — for example, to avoid access to client data or systems — the employer may pay in lieu of notice. This is a lump-sum payment equal to the full salary the employee would have received during the notice period, subject to tax and social insurance deductions.
Pay in lieu is not available where the employee is dismissed for serious misconduct. In those cases, the employer may be able to dismiss immediately without notice or payment — but only if the grounds genuinely justify summary dismissal.
