Israeli Labour Law Applies Regardless of Visa Status

Every foreign worker employed in Israel — whether a caregiver, construction worker, agricultural worker, or any other category — is entitled to the full suite of Israeli labour law protections. The law does not distinguish between Israeli citizens and foreign nationals: minimum wage, severance pay, overtime, annual leave, recuperation pay, sick pay, and pension contributions are all mandatory.

The Foreign Workers Act 5751-1991 reinforces this principle and adds specific obligations on employers of foreign workers. Employers must provide written employment contracts in a language the worker understands, ensure adequate accommodation that meets regulatory standards, and register the worker with the National Insurance Institute from the first day of employment.

Pension contributions are compulsory under the Comprehensive Pension Law. From the first day of work, the employer must deposit contributions to a pension fund on the employee's behalf — regardless of nationality or visa type. Failure to do so creates direct personal liability for the employer and the right to full back-payment with interest.

If you are a foreign worker and have not received the wages, benefits, or conditions you are legally entitled to, you have the right to file a claim in the Israeli Labour Court. The statute of limitations for most labour claims is seven years — meaning unpaid entitlements from previous years can still be recovered.

Common Violations Against Foreign Workers and How to Claim

Despite clear legal protections, foreign workers frequently face specific violations. Understanding what is illegal is the first step toward recovering your rights:

Passport confiscation — retaining a foreign worker's passport, identity document, or visa is a criminal offence. No employer has the right to hold your documents. If this has happened to you, contact a labour attorney immediately.

Excessive housing deductions — an employer providing accommodation may deduct up to 25% of the minimum wage from your salary. Any deduction beyond this ceiling is unlawful and you are entitled to recover the excess. Additionally, the accommodation must meet basic habitability standards set by regulation — overcrowding, lack of sanitation, or unsafe conditions are grounds for a complaint.

Failure to pay NII contributions — employers who do not register workers with the NII or who fail to pay contributions are exposing themselves to significant liability. A worker who is injured at work and has not been registered may still claim NII work-injury benefits, and the employer will be liable for the full shortfall.

Fear of deportation preventing claims — many foreign workers avoid asserting their rights out of fear that filing a claim will result in deportation. In practice, the Labour Court is an independent judicial body and does not report immigration status to the Population and Immigration Authority. Whistleblower protections apply, and an attorney can seek procedural protections during the case. Your right to justice is not conditional on your visa status.

To file a claim, gather all available evidence: employment contracts, pay slips, bank transfers, text messages, and any records of hours worked.
