Maternity Leave Entitlements
The Employment of Women Law and the National Insurance Law together provide comprehensive maternity rights for employed mothers in Israel. An employee with 12 months of service is entitled to 26 weeks of maternity leave, of which 15 weeks are covered by NII maternity benefit (dmei leidah). Mothers with less than 12 months of service receive 15 weeks of leave, all of which is paid.
The NII benefit replaces salary during the paid leave period. It is calculated based on the average salary in the three months before departure — making it important to ensure your salary records are accurate before going on leave.
Protection from Dismissal
Israeli law provides some of the strongest protections in the world for pregnant employees and those on maternity leave. An employer who wishes to dismiss a pregnant employee must obtain written permission from the Ministry of Labor — a requirement that is very rarely granted during pregnancy or leave.
The protection extends to 60 days after the end of maternity leave. Adv. Elmaliach acts quickly for clients who face dismissal or adverse treatment during pregnancy or maternity leave — these cases often result in significant compensation.
