Overtime Pay — The Legal Framework
The Hours of Work and Rest Law (1951) sets the standard working day at 8 hours and the working week at 42 hours. Any work beyond these limits is overtime and must be paid at a premium rate. The first two overtime hours per day are paid at 125% of the regular hourly rate; subsequent overtime hours are paid at 150%.
Employers who require employees to work overtime without paying the statutory premium are liable for unpaid wages plus withholding penalties of up to 50% of the unpaid amount. Adv. Elmaliach handles overtime claims before the Jerusalem Labor Tribunal.
Global Salary Arrangements
Many Israeli employment contracts include a "global salary" component intended to cover overtime. Such arrangements are valid only if the employee explicitly agreed in writing and if the global component genuinely covers all overtime hours worked. Where actual hours routinely exceed what the global component covers, the employee can claim the shortfall.
High-tech employees, in particular, often work long hours beyond what their global overtime component covers. Reviewing whether your contract actually satisfies your overtime entitlement is an important step — especially before or after leaving a job.
