Seasonal Worker Rights in Israel

What Seasonal Workers Are Entitled To

The law does not create a separate, lesser category for seasonal workers. An employee who works on a seasonal basis is entitled to the same protections as any other worker — the only variable is how seniority accumulates. After completing one year of cumulative employment with the same employer, a seasonal worker is entitled to severance pay upon dismissal, recuperation pay, pension contributions, sick pay, and paid annual leave.

The question of seniority accumulation across seasons is critical. Israeli courts have established that consecutive seasonal employment with the same employer — where the employee returns each year and the employer invites them back — is treated as continuous employment for the purpose of most statutory rights. A short off-season gap does not automatically reset the clock.

Pension contributions are also mandatory. Under the Expansion Order for Comprehensive Pension, employers must make contributions to a pension fund for any employee who has been employed for six months or more — including seasonal workers. Many employers in seasonal industries quietly fail to comply with this obligation.

Common Violations and How to Claim

The most common violations against seasonal workers are: failure to pay recuperation pay, refusal to recognize accumulated seniority between seasons, non-payment of severance at the end of a season or at the conclusion of the employment relationship, and failure to make pension contributions. These violations are often deliberate — employers assume seasonal workers will not pursue claims.

Claims can be filed retroactively. The statute of limitations for most employment claims in Israel is seven years — meaning that even if you worked several seasons without receiving what you were owed, you can still claim for past periods. The Labor Tribunal handles these claims relatively quickly, and in many cases claims are resolved in mediation or through a negotiated settlement.

The first step is to gather documentation: pay slips, employment contracts or offer letters, communications about seasonal return, and records of dates worked. If you do not have pay slips, the employer is legally required to provide them. An employment attorney can send a formal demand and negotiate on your behalf — or file in the Labor Tribunal if the employer refuses to cooperate.
