Sick Pay — Entitlements Under Israeli Law

The Sick Pay Law (1976) entitles every employee to accrue 1.5 sick days per month — up to 18 days per year and a cumulative maximum of 90 days. The first day of any illness is unpaid; the second and third days are paid at 50%; from the fourth day onward, full pay applies.

Collective agreements in many sectors — health, education, public service — provide more generous terms, including full pay from the first day and higher accrual rates. Your specific agreement governs where it provides better terms than the statutory minimum.

Protection from Dismissal During Illness

An employer cannot dismiss an employee for the first 30 consecutive days of sick leave. After 30 days, dismissal is permitted with proper notice — but only if the grounds are not discriminatory and all accrued sick pay is settled. Dismissal during protected sick leave can give rise to significant compensation claims.

The Labour Tribunal takes a serious view of employers who use sick leave as a justification for dismissal, particularly where there is a pattern of targeting employees who exercise their rights.
