Easements — The Legal Framework

Easements are a fundamental concept in Israeli land law, governed by the Land Law (1969). They allow one property owner to exercise a specific right over a neighbouring property — most commonly, rights of way, utility pipe routes, and shared access routes. A registered easement follows the land permanently and binds all future owners.

Easement disputes arise where neighbours disagree about the existence, scope, or exercise of an easement right. Adv. Elmaliach advises on all aspects of easement law — creation, registration, enforcement, and extinguishment.
