What Do Real Estate Attorney Services Cost?

The standard market rate for real estate attorney representation in Israel is 0.5% of the transaction value, plus VAT — for both buyers and sellers. On a ₪2,000,000 apartment, this equals ₪10,000 + VAT. The fee covers the full transaction lifecycle.

What is included in the attorney fee:

  • Title search and lien verification at the Land Registry (Tabu)
  • Review and negotiation of the sale and purchase agreement
  • Coordination with the bank and mortgage lender
  • Preparation and submission of all Land Registry registration documents
  • Tax reporting to the Israel Tax Authority (purchase tax / capital gains tax)
  • Escrow coordination and transfer of funds

What is NOT included (paid separately):

  • Purchase tax (מס רכישה) — a government tax paid directly to the Tax Authority
  • Land Registry registration fees — a fixed government fee
  • Betterment levy (היטל השבחה) — payable by the seller to the municipality
  • Mortgage registration fee — charged by the registrar
  • Notary fees (if required for specific documents)

How the fee is typically paid: 50% on signing the purchase agreement and 50% on closing (transfer of possession or Land Registry registration). The exact payment schedule is agreed in writing before engagement.

Additional Government and Registry Costs to Budget For

Beyond the attorney fee, buyers and sellers should anticipate the following government charges. These are paid directly to the relevant authority — not to the attorney.

Purchase Tax (מס רכישה) — Buyer

A graduated tax on the purchase price. First-home buyers pay 0% on the first ₪1,978,745 and 3.5% on the amount between ₪1,978,745 and ₪2,347,040. Investors and non-residents pay 8% from the first shekel, rising to 10% above ₪17,794,305. Rates are updated annually.

Land Registry Registration Fee — Buyer

A fixed government fee for registering the ownership transfer at the Land Registry (Tabu). Currently approximately ₪900–₪1,400 depending on the transaction value.

Betterment Levy (היטל השבחה) — Seller

A municipal charge levied when planning permission changes have increased the value of the property. The levy is 50% of the uplift in value attributable to the planning change. It is the seller's liability and must be verified before signing. Not every property is subject to betterment levy — a municipal search is required.

Mortgage Registration Fee — Buyer (if financing)

If the purchase is mortgage-financed, the lender's charge must be registered at the Land Registry. The registration fee is approximately ₪900–₪1,500.

Building Record Extract Fees

Extracts from the Land Registry (נסח טאבו), Planning and Building Administration records, and municipal files are required as part of due diligence. Each extract costs approximately ₪40–₪100. Total extract costs for a standard transaction are typically ₪300–₪600.
