How the Road Accident Law Applies to Bus Accidents
The Road Accident Victims Compensation Law imposes strict liability on the insurer of any motor vehicle involved in an accident — and a public bus is no exception. This means the insurer of Egged, Dan, Metropoline, or any other bus operator must compensate you for your injuries without requiring you to prove that anyone was at fault.
The law covers a broad range of situations. Passengers on a bus who are injured due to sudden braking, a collision, or any other road event are fully protected. So are pedestrians struck by a bus, and people who are injured while boarding or alighting — slipping on wet steps, being knocked off-balance by a closing door, or falling when the bus pulls away too early.
You do not need to prove the driver was speeding, distracted, or negligent in any way. The sole requirement is to establish that a qualifying accident occurred and that you were injured as a result.
What to do immediately after a bus accident: seek medical attention even if you feel well — some injuries (whiplash, internal bruising, concussion) manifest hours or days later. Report the incident to the bus driver and request their details. Photograph the scene, your injuries, and any relevant surroundings. Do not sign anything for the bus company or its insurer without legal advice.
What You Can Claim and Against Whom
Your claim is filed against the bus company's insurer — not the driver personally, and not the bus company's management directly. The heads of damage you can recover include:
