How the Success Fee Works for Personal Injury

A success fee — also called a contingency fee — means the attorney is paid only if you recover compensation. No recovery, no fee. The fee is a percentage of the total award, typically 15–25% of the sum actually received. The percentage is fixed in writing before any work begins, so there are no hidden costs and no billing surprises.

The attorney covers the time invested in building your case: gathering medical records, instructing experts, drafting pleadings, and attending hearings. If the case does not succeed, that investment is absorbed by the attorney — not charged back to you.

Whether the matter ends in a pre-litigation insurance settlement or a full court judgment, the same agreed percentage applies. Some cases settle quickly at a lower value; others proceed to trial for a larger award. The attorney is incentivised to maximise your recovery at every stage.

Third-party disbursements — medical expert fees, court filing fees, record requests — are separate from the attorney fee. We explain these at the outset. In most personal injury matters they are modest, and where possible they are advanced by the firm pending the outcome of the case.

Why No Win No Fee Makes Sense for Injury Cases

The success fee model exists for a reason: personal injury plaintiffs are typically dealing with physical recovery, lost income, and mounting medical costs. They cannot afford to pay hourly legal fees — often tens of thousands of shekels — with no guarantee of a result. The success fee removes that barrier entirely.

It also aligns incentives perfectly. The attorney earns more only when you earn more. An attorney billing by the hour has no financial interest in the size of your award. An attorney on success fee is motivated to fight for the maximum compensation, because their fee moves in lockstep with your recovery.

If the case is strong, we proceed on a success fee. If it is not viable, we say so plainly — saving you time and false hope.
