Writing a Will Before Surgery in Israel

Surgery is approaching and you have not yet made a will. Adv. Liron Yitzhak Elmaliach explains the valid options available to you — including options that can be completed today, without an office visit.
Same-Day Will Options in Israel
Israeli law recognises four types of wills. Three of them can be completed before surgery with little or no advance planning. Here is what each one requires:
Handwritten Will (צוואה בכתב יד) — valid today, no witnesses required
Entirely handwritten by the testator, signed and dated with a full date (day, month, year). No witnesses, no notary, and no appointment are needed. The simplest and fastest option — you need only paper and a pen. Valid as soon as you finish writing and sign.
Witnessed Will (צוואה בפני עדים) — valid today with two witnesses
Typed or handwritten, signed by the testator in the presence of two adult witnesses who are not beneficiaries under the will. Both witnesses sign to confirm they witnessed the signing. Can be completed on the same day if two eligible witnesses are available.
Notarial Will (צוואה בפני רשות) — most secure, requires appointment
Made before a notary, court clerk, or judge. Requires scheduling an appointment in advance. The process takes longer than the other options, but produces the most legally robust document — the official record makes challenges significantly harder. Recommended when time permits.
Oral Will (צוואה בעל פה) — for deathbed situations only, not recommended pre-surgery
Permitted only when a person is on their deathbed and physically unable to write. The testator states their wishes aloud before two witnesses who record them in writing. Because elective surgery does not meet the legal threshold, an oral will made before a planned operation is unlikely to be recognised. Use one of the written options above instead.
What to Include in a Quick Pre-Surgery Will
Even a will written in a short time must include all essential elements to be legally valid and clearly understood after your death. Here is what matters most:
Essential formal elements
Full name and ID number of the testator; a complete date (day, month, year); clear identification of heirs with their full names and ID numbers; and your signature at the end of the document. Missing any of these can invalidate an otherwise well-written will.
Who can be a witness — and who cannot
Any adult with legal capacity can serve as a witness — except a person who benefits under the will or their spouse. Using a beneficiary as a witness does not void the entire will, but may cancel that person's share. Choose two witnesses who receive nothing under the will.
What makes a handwritten will invalid
The most common mistakes: using any printed or typed text (even a single printed word); an incomplete date; a signature that is not at the end; or any part written by another person. If you download a template and fill it in, the will is invalid — the entire document must be in your own handwriting.
Registering the will with the court for safekeeping
After writing your will, consider depositing it with the Inheritance Registrar (רשם הירושות) for a small fee. The document is kept confidential during your lifetime and released only after your death. A will that cannot be found cannot be probated — registration prevents it from being lost or destroyed.
Coordinating with a Continuing Power of Attorney
A will takes effect after death. A Continuing Power of Attorney (ייפוי כוח מתמשך) takes effect while you are alive — when you are unable to make decisions. Before surgery, it is worth considering both documents together: the will determines what happens to your assets after death, while the CPoA ensures that trusted people can manage your affairs and make medical decisions on your behalf if you cannot do so yourself.
