Custody Rights for Fathers — a Changing Legal Landscape

For decades, Israeli family courts applied the tender years doctrine — a presumption that mothers should have custody of children under six. This presumption has been significantly weakened in recent Israeli case law. Today courts apply a best-interests-of-the-child standard that evaluates each family individually, and shared custody is increasingly granted to fathers who can demonstrate meaningful involvement in parenting.

What fathers need to show: an active role in the child's daily life, a stable home environment, the ability to cooperate with the other parent, and a concrete and realistic parenting plan. Courts look at continuity — a father who has been consistently present carries far more weight than one who attempts to become involved only after proceedings begin.

Parental alienation — where one parent systematically undermines the child's relationship with the other — is now a recognised and serious factor. Israeli welfare officers and judges are increasingly alert to alienating behaviour, and documented alienation can shift custody decisions in the alienated parent's favour.

Financial Rights and Obligations — Property, Alimony & Child Support

A father going through divorce has the same property division rights as his spouse. Assets accumulated during the marriage — including the shared apartment — are subject to equal division under the Spouses (Property Relations) Law. It is important to take an inventory of all assets and liabilities early, before positions harden.

Spousal support: the obligation to pay alimony in Israel is not automatic and is not exclusively the husband's burden. Where there is a significant income disparity — and in some circumstances a husband's earning capacity is substantially lower than his wife's — a husband may file a claim for spousal support. This is relatively rare but legally available.

Pension rights: pension savings accumulated during the marriage are marital property subject to division. Each spouse is entitled to a share of the other's pension, provident funds, and other long-term savings. This is often overlooked but can be the most significant asset in a divorce.

Child support when the father has primary custody: child support is calculated based on the income of both parents and the time each parent spends with the children. When a father has primary or equal custody, the standard child support tables are adjusted accordingly, and in some cases the mother may be required to pay support to the father.
